Terms of Service

These Terms of Service (“Terms”) are between you (“User,” “You,” “Your”) and HBX Marketing LLC DBA Oneweekhire (“Company,” “We,” “Us,” “Our”), governing your access to and use of our website, platform, services, and any SMS/text message communications (collectively, the “Services”).
By accessing or using our Services (including opting in to receive text messages from us), you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Services or opt in to our messaging.
1. Scope & Acceptance
- These Terms govern all use of oneweekhire.com and related services, including SMS/text message communication (“Messaging Services”).
- Additional rules, policies, or disclosures posted elsewhere (e.g., in forms, subscription pages) are incorporated by reference.
- We may modify these Terms at any time; material changes will be communicated (e.g., via email or site notice). Continued use / opt-in after changes equals acceptance.
2. Eligibility & User Responsibilities
- You must be at least 18 years old (or the legal age in your jurisdiction) to use the Services, including Messaging Services.
- When registering / opting in, you agree to provide accurate, current, and complete information.
- You agree that any phone number you provide is yours (or that you have the right to use it) and that you consent to receive messages at that number.
- You must comply with all applicable laws, including those governing text messaging, spam, and consumer protection. You will not misuse messaging (e.g., spam, fraudulent content, unsolicited messages beyond your opt-in).
3. Messaging / SMS / 10DLC Use & Opt-In / Consent
- Opt-In / Consent: You must explicitly opt in to receive text messages from us. This may be through a web form, app, in-person form, or other lawful means. You are not required to consent for non-messaging parts of the Services. A checkbox (not pre-checked) or similar mechanism will be used where required.
- Confirmation (Double Opt-In): Where required, after your initial opt-in you may receive a confirmation message (e.g., “Reply YES to confirm subscription”). Only once confirmed will marketing messages begin.
- Message Types & Frequency: We may send promotional offers, service updates, account reminders, scheduling notices, etc. Frequency will vary depending on your preferences or activity.
- Message & Data Rates: Standard carrier rates may apply.
- Opt-Out: You may opt out at any time. Instructions will be included in each message (e.g., “Reply STOP to opt out”). Once you opt out, we will cease those messages promptly. Important transactional/account-related messages may still be sent where required.
- HELP / Support: Each message will include help info (“Reply HELP” or similar, or email/support contact).
4. Our Services & Plans
- We offer hiring, short-term staffing, job matching, contract roles, etc.
- Plans include defined features, deliverables, or hours. Unused hours/credits/deliverables do not carry over unless explicitly stated.
- Pricing is as shown on the site at purchase. Custom services not in standard plans may incur additional fees.
- Payment must be via valid method. If payment fails, access may be suspended or terminated until resolved.
5. Subscriptions, Term & Cancellation
- Subscriptions or agreements begin on enrollment/purchase date and continue for the selected period (monthly, weekly, project-based, etc.).
- Automatic renewal occurs if your plan stipulates it.
- To cancel, you must give notice as required by your plan. Any fees or obligations must be honored.
- Early cancellation fees may apply if specified.
6. Ownership & Use of Content / Work Product
- You retain ownership of materials you provide (logos, content, etc.).
- For work we create specifically for you (“Work Product”), we grant you a non-exclusive, royalty-free, perpetual license for your business purposes.
- We may use aggregated, non-identifiable data for improvement, analytics, and marketing.
7. Confidentiality & Data Protection
- “Confidential Information” means non-public business, technical, financial, or personal data you provide.
- We will protect such information and not disclose it except as required by law or necessary to perform the Services.
- We follow industry-standard security practices, but cannot guarantee perfect security. We are not liable for certain breaches to the extent permitted by law.
8. Disclaimers & No Warranty
The Services (including Messaging Services) are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee outcomes (e.g., job placements) or specific performance of messaging (e.g., delivery times).
9. Limitation of Liability
To the maximum extent permitted by law, HBX Marketing LLC DBA Oneweekhire and its affiliates, officers, employees, and agents shall not be liable for indirect, incidental, special, punitive, or consequential damages. Our total aggregate liability shall not exceed the amount you have paid us in the prior 12 months, or a statutory minimum if required.
10. Non-Solicitation / Non-Compete
If your use of our Services connects you with contractors/workers, you agree not to directly hire, solicit, or engage them outside of Oneweekhire for 12 months after your last engagement, unless we agree in writing.
11. Use of Name, Testimonials, & Feedback
With your consent, we may use your name, logo, or non-confidential feedback in our marketing materials. If you wish to opt out, contact us; we will cease within a reasonable period.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Texas, United States. Disputes shall be resolved in Texas courts unless otherwise agreed. If a provision is invalid, the remainder continues in effect.
13. Miscellaneous
- Entire Agreement: These Terms, the Privacy Policy, and any SMS Consent disclosures form the entire agreement.
- No Waiver: Failure to enforce a breach does not waive our rights later.
- Severability: If any provision is invalid, the remaining terms still apply.
14. Messaging-Specific Disclosures & Requirements (A2P / 10DLC)
- We are registered with The Campaign Registry (TCR) for messaging compliance.
- Our brand name for messaging is “HBX Marketing LLC DBA Oneweekhire.”
- Messages will originate from: +1 646-759-0421.
- Sample message: “ONEWEEKHIRE: You have a job match request. Reply HELP for help or STOP to unsubscribe.”
- You may receive up to ~5 messages/month or more depending on engagement.
- Message & data rates may apply per carrier.
